Hello!  My name is Debbie Jay. Thank you for engaging my service, The Mama Circle, ABN 59 457 998 557 to help gain the best outcomes for you and your child in your breastfeeding journey.

The Mama Circle helps mums to reach their breastfeeding goals by establishing breastfeeding, overcoming specific breastfeeding challenges and navigating the resolution of tongue-ties and oral restrictions in newborns and toddlers.

This document describes my service terms and conditions and is an agreement between you (the mum seeking breastfeeding support) and I (Debbie Jay, The Mama Circle), about how best to work together so we both enjoy the experience!  

Please read this document carefully. While it is expected that this Agreement will be signed and returned by you, sometimes as a new mum it’s not possible.  This document will be provided to you at the time you book and by email.  Please make the time to read it as you are deemed to have read and accepted the Terms and Conditions contained in this Agreement upon receipt by you AND by continuing to accept and engage the services of The Mama Circle

In this Agreement, Debbie Jay, The Mama Circle may also be referred to as “the Practitioner”.

Terms of Engagement

Core Service

The Mama Circle provides one on one coaching and support to mums dealing with breastfeeding and oral restriction challenges with their children.

During the session, a number of lifestyle, health and relationship issues will be covered to enable the practitioner to be fully informed about your and your child’s circumstances for appropriate support and advice and be provided.

The Practitioner will provide information, coaching and advice to support you at whatever stage of the breastfeeding journey you may be at to help you achieve positive outcomes for you and your child.

 

You understand and agree:

Client Intake Form

  1. You may be required to complete a Client Intake Form where you will be asked to provide details about you and your child's health, relationship, and lifestyle.

  2. You are responsible for providing accurate and relevant information to the Practitioner at all times.

  3. You will complete and return the Client Intake Form to the Practitioner 24 hours prior to the booked session.

Privacy

  1. Information requested in the Client Intake Form is personal information and your consent to provide this information will require confirmation in the Client Intake Form.

  2.  Your private information is protected by our Privacy Policy (hyperlink).

Bookings

  1. All session bookings are requested and confirmed via Acuity (online calendar).

  2. If a booking is required outside the hours available in the online calendar please contact the Practitioner on deb@themamacircle.com.au to arrange a mutually suitable session time.

  3. All Sessions are pre-paid and non-transferrable.

  4. No sessions may include or be attended by any third parties unless approved in prior discussions with the practitioner.

  5. Late arrival for a session will result in a shorter session with the session concluding at the usual time. 

Rescheduling Sessions

  1. In the event of illness or unforeseen circumstances, you or the Practitioner may reschedule a session on the online calendar. 

  2. No guarantee by the Practitioner is provided that your preferred time for the rescheduled session will be available. 

 

Payment 

You understand and agree:    

  1. All sessions are prepaid and payments are required to be completed online at the time of booking your session.

  2. Payments may be made by bank transfer. Bank details are available upon request. 

  3. All prices are listed in Australian Dollars.

  4. All prices are exclusive of GST

  5. The Mama Circle reserves the right to change service fees at any time.

 

Cancellations and Refunds

  1. You may cancel a booked session more than 24 hours of the booked session with a refund less $35 administration fee.

  2. There is no refund for cancellations within 24 hours of the session. 

  3. All requests for cancellation of services and refund of session fees must be made in writing by email to deb@themamacircle.com.au

 

Feedback & Dispute Resolution

Your feedback is important!

You understand and agree:

  1. You will contact the Practitioner immediately with any concerns so that they may be resolved quickly and effectively.

  2. In the event of a dispute you agree to the following Dispute Resolution Procedure:

  3. You must advise the Practitioner in writing of the nature of the dispute, the outcome you seek and what actions you believe will settle the dispute. 

  4. You agree to meet in person, via Zoom or similar online platform, in good faith to seek to resolve the dispute by agreement and compromise.

  5. If an agreement cannot be reached to resolve the dispute any party may refer to a mediator (via Zoom only) who will determine time and place for mediation. 

  6. Both parties (you and the Practitioner) must attend the mediation referred by the mediator, in good faith, to seek to resolve the dispute through mediation or other alternative dispute resolution processes.

  7. Confidentiality is paramount to both the reputation of you and the Practitioner.

  8. At no time will any communications or discussions be made public. This includes but is not limited to any social media websites of either party. 

  9. Any public discussion or comments about either party will be considered defamatory, negative or otherwise damaging and will be the subject of compensation in any mediation or litigation claim.

 

Acknowledgment & Disclaimer

You understand and agree:

  1. You have engaged the Practitioner for breastfeeding and oral restriction support and coaching services at the agreed Fee.

  2. The Practitioner is not a pediatric medical professional, a dental health professional, a medical doctor or dentist, a psychologist, or medically trained, and is not medically qualified to assess your or your child's physical or mental medical condition including oral health and breastfeeding implication. 

  3. If you are in any doubt, please seek expert medical advice about the services provided by Debbie Jay.  

Limitation of Liability

You understand and agree:

  1. Liability for the services provided by Debbie Jay is governed solely by the Australian Consumer Law and these Terms and Conditions.  

  2. Nothing in these Terms removes your Statutory Rights as a consumer under Australian Consumer Law. 

  3. Except for your Statutory Rights, all material (including by not limited to educational and demonstration videos and other material) and services are provided to you without warranties of any kind, either express or implied; and Debbie Jay expressly disclaim all warranties of any kind including but not limited to implied warranties of merchantability and fitness for a particular purpose.

  4. To the extent permitted by law, Debbie Jay excludes all express or implied representations, conditions, guarantees, warranties and terms relating to any Services except those set out in this Agreement, including but not limited to implied or express guarantees, warranties, representations or conditions of any kind, which are not stated in this Agreement.

  5. Debbie Jay guarantees all services are supplied to you with due care and skill and fit for the purpose that the services have been advertised.

  6. Debbie Jay cannot and does not guarantee that you, the Client, will take the necessary actions identified during the sessions to achieve a specific result. What you achieve through these sessions are your choice and responsibility. 

  7. To the extent that Debbie Jay is unable to exclude liability, total liability for loss or damage you suffer or incur from Services by Debbie Jay is limited to re-supplying the Services to you, or, at the Practitioner’s option, refunding to you the amount you have paid for the Services to which your claim relates.

 

Governing Law 

You understand and agree the Terms and Conditions in this Agreement are governed by and construed in accordance with the laws of the state of Queensland, Australia.
